Privacy Policy

1031brain ("1031brain", "we", "us") provides software that helps investors, their Qualified Intermediaries, and our support team manage a 1031 like-kind exchange. This policy explains what we collect, why, who we share it with, and what email we send you. Questions go to hello@1031brain.com.
Information we collect
We collect only what the service needs to function:
- Account information you give us directly — name, email address, phone number, and mailing address.
- Exchange information you enter — property addresses, closing dates, sale and purchase figures, mortgage balances, depreciation, your tax bracket range and state of residence, and your replacement-property preferences.
- Documents you or your Qualified Intermediary upload to the exchange.
- Messages you exchange with your Qualified Intermediary or our team through the platform.
- Technical and security data — IP address, browser type, and an audit log of significant actions (sign-in, document upload, identification submitted) so we can secure accounts and investigate problems.
We do not buy contact lists, and we do not collect information from anyone who has not chosen to use the service.
How we use it
To operate your exchange: computing your 45-day and 180-day deadlines, producing your identification documents, sharing the exchange with the Qualified Intermediary you select or that we assign at your request, providing support, securing the service, and meeting our legal obligations. We do not sell your personal information, and we do not share it with advertisers.
Email we send you
We collect your email address only when you create an account or are invited to an exchange by your Qualified Intermediary. We send transactional email only — messages required to operate the service you signed up for:
- Address verification when you sign up, and password-reset links you request.
- Invitations to join an exchange.
- Deadline reminders as your 45-day identification and 180-day closing dates approach. These are the core purpose of the product, and we consider them essential to the service rather than marketing.
- Notifications when your Qualified Intermediary messages you, acknowledges your identification, or completes a step.
We do not send promotional or marketing email to our users, and we do not send bulk campaigns. You can stop all non-essential notification email by contacting us at hello@1031brain.com or by closing your account; note that closing your account ends the deadline reminders that protect your exchange. We monitor bounces and complaints and promptly stop sending to any address that hard-bounces or reports our mail as spam.
Who we share it with
Your exchange is visible to the Qualified Intermediary assigned to it and, where needed to support you, to 1031brain staff — access is logged. We also rely on service providers who process data on our behalf: cloud hosting and infrastructure, database hosting, file storage, email delivery, error monitoring, and address autocomplete. They may only use the data to provide those services to us. We may disclose information if required by law or to protect the rights and safety of our users.
How we protect it
Traffic is encrypted in transit. Passwords are hashed with Argon2id and never stored in readable form. Uploaded documents are stored encrypted at rest and are reachable only through short-lived, signed links — never from a public URL. Accounts with cross-organization visibility require two-factor authentication. Every significant action is written to an audit log. No system is perfectly secure, but we treat this data as sensitive because it is.
Retention
We keep your exchange records for as long as your account is active and afterwards where we need them to meet legal, tax, audit, or dispute-resolution obligations — a 1031 exchange can be examined years after it closes. Ask us to delete your account and we will, subject to those obligations.
Your choices
You can review and correct your information in the app, or ask us to access, correct, export, or delete it by emailing hello@1031brain.com. Depending on where you live, you may have additional rights under applicable privacy law; we honor those requests without discriminating against you for making them.
Cookies
We use a single essential cookie to keep you signed in. We do not run advertising trackers or third-party analytics on this site.
Children
The service is intended for adults conducting real-estate transactions and is not directed to anyone under 18.
Changes and contact
